Terms and Conditions for My Travel Locker LLC

Article 1: Introduction

This legal document, herein referred to as the "Agreement," sets forth the Terms of Service ("Terms" or "TOS") that govern the use of www.mytravellocker.com (the "Website") and all associated services provided by City Stroller Rentals, Pixie Magic, and My Travel Locker, including but not limited to any related mobile applications (collectively, the "Services"). By accessing, browsing, or utilizing the Services, you, the customer (hereinafter referred to as "You" or "Your"), hereby acknowledge and agree to be legally bound by these Terms and Conditions. It is imperative that you read this Agreement thoroughly and carefully. If at any point you find yourself unable to agree to these Terms, you must cease all access and use of the Services immediately.

Your use of the Services constitutes an unequivocal acceptance of, and agreement to, all such Terms outlined herein. This Agreement encompasses any and all use of the Services, whether the access is for personal or commercial purposes.

By proceeding to use the Services, you also confirm that you are of legal age and possess the legal authority to enter into this Agreement. Moreover, you affirm that your use of the Website and Services will not contravene any applicable laws or regulations.

The terms and conditions set forth in this Agreement may be amended, updated, or altered by City Stroller Rentals, Pixie Magic, and My Travel Locker at any given time and without prior notice to You. Such revisions will be effective immediately upon their posting on the Website or within the Services. Your continued use of the Services post any changes signifies your unconditional acceptance of the modified Terms. Therefore, we encourage you to periodically review this Agreement to ensure you are updated on any changes.

Article 2: Requirement for Careful Review

This section mandates the careful and thorough examination of this document by you, the user. By engaging with and utilizing the services provided by City Stroller Rentals and My Travel Locker, you acknowledge, accept, and agree to comply with all terms and conditions stipulated herein. Your use of our services is contingent upon such acceptance and constitutes a legal agreement between you and the aforementioned entities.

Understanding of Rights and Obligations: It is imperative that you fully comprehend your rights and obligations under this Agreement, as well as the rights and obligations of City Stroller Rentals and My Travel Locker. This comprehensive understanding will guide your use of our services.

Arbitration Agreement: Please be advised that these Terms include clauses that govern the resolution of disputes between you and My Travel Locker. Specifically, these clauses typically mandate that any disputes be resolved through binding and final arbitration conducted on an individual basis, rather than through any class, collective, or representative proceedings.

Definition and Scope: For clarity and the purpose of these Terms, references to "My Travel Locker," "MyTravelLocker.com," the "Company," "we," "us," or any other variations thereof, shall mean My Travel Locker, LLC, a legally formed limited liability company in the State of California. The scope of these Terms encompasses all interactions with www.mytravellocker.com and any related services, including but not limited to mobile and tablet applications provided by My Travel Locker.

Acceptance of Terms: To utilize the services offered by My Travel Locker, you must agree to these Terms in full. This agreement extends to our Privacy Policy, Pricing Structure, Storage Guidelines, Liability Terms, and any other policies or terms we may publish. These additional documents are hereby incorporated by reference into this Agreement. My Travel Locker reserves the right to modify or update these Terms at any time without prior notice by posting the amended terms on www.MyTravelLocker.com. Your continued use of our services subsequent to any such changes constitutes your acceptance of the new terms.

Eligibility: You must be at least eighteen (18) years of age to use the services provided by City Stroller Rentals and My Travel Locker. Additionally, to be eligible for the My Travel Locker Storage Valet Service, you must affirm that you are the sole owner of the property stored with My Travel Locker and that you are not storing items on behalf of others. There will be no exceptions to this rule.

By proceeding with our services, you confirm your understanding and acceptance of these conditions.

Article 3: Notification of Military Service Status

Record of Military Status: My Travel Locker requires disclosure of your status if you are serving in the Military, given the existence of special procedures that apply to the storage needs of active duty service personnel. Within the context of this provision, "Military" encompasses the following: (i) individuals actively serving in the U.S. Army, U.S. Navy, U.S. Air Force, U.S. Marine Corps, or U.S. Coast Guard, including reservists called to active duty and members absent from duty due to injuries or granted leave; (ii) members of the National Guard who have been activated under specific orders; and (iii) active service commissioned officers of the Public Health Service or the National Oceanic and Atmospheric Administration.

Obligation to Notify of Status Changes: If you are a Military service member, it is imperative that you promptly inform My Travel Locker of any alterations to your Military status or assignment that necessitate updates to your email, mailing address, phone number, or any other contact information previously furnished to My Travel Locker. This obligation ensures uninterrupted service and compliance with relevant Military service regulations applicable to your storage arrangements.

Notification Requirements Upon Enlistment or Commissioning: Should you enlist, be commissioned, or otherwise enter Military service subsequent to entering into this Agreement, you are required to notify My Travel Locker of your new status in writing within thirty (30) days of such commencement. Alongside this notification, you must provide all necessary updates or changes to your contact information to ensure continuous and accurate communication.

Exclusion of Sensitive Information: While we require updated contact information, My Travel Locker respects the confidentiality and sensitivity of Military operations. As such, we do not expect nor require you to disclose any information pertaining to confidential or classified field locations.

Compliance and Communication: Adhering to these notification requirements is crucial for maintaining the efficacy and legality of our service agreements, particularly in the context of the unique needs and protections afforded to Military personnel. Your cooperation and compliance with these provisions are greatly appreciated and are essential to our commitment to serving the needs of our Military customers effectively.

Article 4: Locker, Pick-ups, and Deliveries Policy

General Provisions: My Travel Locker is committed to handling your belongings with the highest degree of care, attention to detail, and convenience. In our endeavor to provide an exemplary service experience, we have instituted a policy governing the scheduling and management of locker allocations, as well as the pick-up and delivery of your items.

Locker Allocation and Access: Lockers provided by My Travel Locker are allocated based on availability and customer requirements. We reserve the right to assign, reassign, or relocate lockers as necessary to optimize service delivery and accommodate all customer needs efficiently.

Scheduling of Pick-ups and Deliveries: The scheduling of pick-ups and deliveries is under the exclusive control of My Travel Locker. We aim to ensure that these services are conducted in a manner that is both efficient and organized, minimizing inconvenience to our customers while maximizing the safety and security of your belongings.

Customer Responsibilities: Customers are required to adhere to the scheduled pick-up and delivery times as determined by My Travel Locker. Failure to comply with these schedules may result in delays, additional fees, or the rescheduling of services. Customers are encouraged to communicate any specific needs or constraints regarding pick-ups and deliveries in advance, to allow us to provide the best possible service.

Changes and Cancellations: We understand that plans can change. Customers may request changes or cancellations to scheduled pick-ups or deliveries; however, such requests must be made within a specified timeframe to avoid any potential fees or inconvenience. My Travel Locker will make every reasonable effort to accommodate these requests but cannot guarantee changes can always be fulfilled depending on timing and resource availability.

Liability and Damages: My Travel Locker assumes responsibility for your belongings from the moment of pick-up until delivery is completed. However, it is imperative for customers to ensure that all items are securely packed and labeled correctly. My Travel Locker shall not be liable for damage to items due to inadequate packing or labeling by the customer.

Final Provisions: This policy is subject to change at the discretion of My Travel Locker without prior notice to customers. We advise all customers to review this policy regularly to stay informed of any updates. Your continued use of My Travel Locker's services following any policy changes constitutes acceptance of those changes.

Article 5: Storage Facilities Policy

Scope of Storage Facilities: My Travel Locker operates and maintains various storage facilities designed to accommodate the safe and secure storage of your Tote/Bin(s). These facilities are equipped and managed to uphold the highest standards of security and reliability to ensure the safety and integrity of your stored items.

Sub-Leasing of Storage Space: To enhance operational flexibility and to meet the storage needs of all customers, My Travel Locker reserves the right to sub-lease storage space from third-party providers. This approach allows us to expand our storage capabilities and ensure that customer items are stored in locations that adhere to our stringent security and quality standards.

Storage Facility Standards: All storage facilities used by My Travel Locker, whether owned directly or sub-leased, are required to meet specific standards concerning security, climate control, cleanliness, and accessibility. We commit to maintaining these standards to protect your belongings and provide peace of mind.

Relocation of Stored Items: My Travel Locker reserves the right to relocate Tote/Bin(s) between storage facilities as necessary. Such relocations will be conducted with the utmost care and professionalism to ensure the continued security and safety of your items. Customers will be notified in the event of any significant relocations that may impact the terms of service or access to stored items.

Article 6: Operating Hours Policy

General Statement on Operating Hours: My Travel Locker establishes operating hours for each service location based on a variety of factors, including but not limited to customer demand, resource availability, and local regulations. These operating hours are determined and set solely at the discretion of My Travel Locker to ensure optimal service delivery while effectively managing our resources.

Variability of Operating Hours: Please be advised that our normal operating hours may vary by location. Such variability allows us to tailor our services to the specific needs and circumstances of each service area, ensuring that we provide efficient and effective solutions to our customers.

Notification of Operating Hours: My Travel Locker commits to clearly posting the operating hours for each service location on our website and at each physical site. Customers are encouraged to consult these resources or contact our customer service team to verify the operating hours for their specific location.

Article 7: Delivery Pricing and Options Policy

Basis for Delivery Pricing: My Travel Locker employs a structured approach to determine delivery pricing, primarily based on the geographical location of the delivery destination. Customers are encouraged to refer to our published Fee Schedule for detailed information on delivery costs associated with various locations and services.

Variability in Delivery Pricing: We acknowledge the diversity of our customer needs and geographical service areas; therefore, we maintain the flexibility to adjust delivery pricing based on several factors, including but not limited to the delivery distance from our facilities, the specific location to which items are being delivered, the time of day, and other logistical considerations. This flexibility ensures that our pricing structure fairly and accurately reflects the costs incurred in delivering your items under differing circumstances.

Requesting Alternative Delivery Locations: Customers have the option to request the delivery of their stored items to locations other than the original pick-up point. Such requests are subject to review and approval by My Travel Locker. In aligning with our commitment to flexibility and customer service, we will endeavor to accommodate such requests whenever feasible.

Article 8: Prohibited Items Policy

Purpose and Scope: At My Travel Locker Storage, ensuring the safety and security of our employees, customers, and their stored belongings is paramount. To maintain a secure and hazard-free environment within our storage facilities, we strictly prohibit the storage of certain items. This policy outlines the categories of prohibited items to prevent any misunderstanding and to ensure the safety and integrity of our storage services.

List of Prohibited Items:

  1. Firearms and Weapons: Any items primarily designed or used as a weapon, including but not limited to firearms, are strictly banned from our facilities.

  2. Tracking Devices: The use of active tracking devices such as Airtags, Tiles, or any other Bluetooth and network tracking devices within stored items is prohibited to protect the privacy and security of all customers.

  3. Illegal Items: The storage of drugs, drug paraphernalia, stolen property, or any items deemed illegal under federal, state, or local laws is expressly forbidden.

  4. Explosive or Combustible Materials: Items such as ammunition, explosives, fireworks, gasoline, oil, kerosene, paint, and lighter fluid pose significant risks and are not permitted within our storage units.

  5. Living Organisms: We prohibit the storage of house plants, fruits, meats, cheeses, animals, insects, and any fungal or bacterial cultures to prevent decay and contamination.

  6. Edible Items: To avoid attracting pests, both perishable and non-perishable food items are banned, except for sealed cooking spices.

  7. Items Attracting Insects or Vermin: We do not allow storage of any items that could potentially attract insects or vermin, including hazardous items, toxic materials, or items that produce gases or odors.

  8. Unprepared or Unpackaged Items: Items must be adequately prepared and packaged for storage to ensure they do not pose a risk to the facility, other customers' belongings, or our employees.

  9. Items Posing General Hazards: Any items that could potentially escape the storage   area, increase in size, burst, or otherwise cause harm to individuals, other stored items, or the storage facility itself are strictly prohibited.

Compliance and Enforcement: Adherence to this policy is mandatory for all customers. My Travel Locker Storage reserves the right to inspect units for compliance and to take appropriate action, including the removal of prohibited items, should any be discovered. Customers found in violation of this policy may face termination of their storage agreement and additional penalties as applicable.

Questions and Clarifications: We understand that certain items may not clearly fall into these categories. If you have any doubts or require clarification regarding the eligibility of specific items for storage, please contact our staff for guidance. We are here to assist and ensure your storage experience is both safe and compliant with all regulations.

Acknowledgement: Your cooperation in adhering to these guidelines is essential and greatly appreciated. By utilizing our storage services, you acknowledge and agree to comply with this Prohibited Items Policy. Your understanding and cooperation help maintain a safe and secure environment for everyone involved.

Article 9: Fragile Items Policy Limitations

Policy Overview: At My Travel Locker Storage, while we strive to provide the safest and most secure storage environment for all your belongings, it is important to note that our policy has specific limitations regarding fragile items. This document outlines the scope of these limitations, provides a definition for fragile items, and offers storage guidelines to help mitigate risk.

Exclusion from Policy Coverage: Please be aware that fragile items are not covered under our standard liability policy. My Travel Locker Storage assumes no liability for damage to items identified as fragile, including, but not limited to, cracks, scratches, breakage, or mechanical failure. The exclusion applies regardless of whether such items were packed by the customer or by My Travel Locker staff.

Storage and Packing Guidelines: While the storage of fragile items within your Tote/Bin is not prohibited, we strongly advise against it due to the heightened risk of damage. Should you choose to store fragile items, we recommend the following precautions:

  • Use adequate padding materials such as bubble wrap, packing paper, or foam inserts to protect the items.

  • Securely seal and label boxes containing fragile items to alert handlers of their contents.

  • Consider double-boxing particularly delicate items for added protection.

My Travel Locker reserves the right to refuse acceptance of items that, in our judgment, have been inadequately packed or pose a risk to other stored goods. In certain instances, we may require the purchase of additional packing supplies or mandate the use of our professional packing services to ensure the safe storage of your belongings.

Customer Responsibilities: By adhering to this policy and employing proper packing techniques, customers can significantly reduce the risk of damage to fragile items. It is the customer's responsibility to ensure that all fragile items are appropriately secured and marked before storage. Failure to comply with these guidelines may result in the refusal of storage services or the voiding of any potential liability claims related to the stored items.

Acknowledgment and Acceptance: By choosing to store fragile items within My Travel Locker facilities, you acknowledge and accept the limitations outlined in this policy. Understanding and adhering to these guidelines is crucial for ensuring the safety and integrity of your fragile belongings while in our care.

Article 10: Valuable Documents Policy

Prohibited Items for Storage: To safeguard the interests of our customers and maintain the integrity of our storage environment, the following categories of items are explicitly prohibited from being stored within our facilities:

  1. Sensitive Personal Documents: This includes, but is not limited to, passports, driver's licenses, green cards, visas, birth certificates, marriage certificates, and any other official personal documents.

  2. Items Containing Personally Identifiable Information (PII): Documents or items that include sensitive information such as dates of birth, social security numbers, bank account details, and any other information that could be used for identity theft are strictly prohibited.

  3. Magic Key Passes: Due to their unique and irreplaceable nature, Magic Key passes are not permitted for storage.

Please note that this list is not exhaustive. We urge our customers to exercise caution and refrain from storing any documents or items that could lead to identity theft or that may be required on an immediate basis.

Customer Acknowledgment and Liability: By choosing to utilize our storage services, customers acknowledge and accept the recommendations and restrictions outlined in this policy. Should a customer decide to store valuable documents against our advice, they do so at their own risk. It is important to understand that customers waive all rights and claims against My Travel Locker Storage arising from the storage of prohibited items, including but not limited to, losses, damages, or identity theft related to the storage of such items.

Article 11: My Travel Locker Packing Instructions

Packing Guidelines:

  1. Proper Packing:

    • Items should be packed in a way that minimizes the risk of damage during transportation and storage. Use appropriate cushioning and protective materials for fragile or delicate items, ensuring they are securely wrapped and placed within the Tote/Bin.

  2. Sturdiness:

    • Contents should be sturdy and well-arranged to withstand occasional movement and handling. Items must be securely positioned within the Tote/Bin to prevent shifting, which could lead to damage.

  3. Weight Limit:

    • The total weight of each Tote/Bin, excluding the container itself, should not exceed 50 pounds. Adherence to this weight limit is essential to prevent overpacking. An overpacking fee of $5.00 per pound may be applied for Tote/Bins exceeding this limit, or we may opt not to accept the Tote/Bin for transport and storage.

Customer Acknowledgment: By utilizing the pickup or storage services offered by My Travel Locker, you confirm that you have read, understood, and agreed to comply with these packing guidelines. It is understood that My Travel Locker will not be held liable for any damages resulting from inadequately packed items.

Liability and Responsibility: While My Travel Locker takes all necessary precautions to handle your belongings with care, the responsibility for proper packing rests with you, the customer. Adequate packing is essential to prevent damage during the normal course of transit and storage.

Article 12: Digital Files Policy (Including Camera SD Cards)

Pre-Storage Recommendations:

  1. Backup Creation: We strongly recommend that all customers create multiple copies of their digital files prior to placing them in our storage bins. This step ensures an additional layer of security and aids in the preservation of your data.

  2. Multiple Storage Media: To minimize the risk of data loss, we advise storing backup copies on various types of storage media. Diversifying storage solutions can significantly reduce the chances of simultaneous data loss across all copies.

Storage Guidance:

  • While storing digital files in our facilities, ensure that they are placed within protective cases or enclosures to shield them from physical damage or electromagnetic interference.

  • Clearly label your storage media to facilitate easy identification and reduce the risk of misplacement or accidental deletion.

Limitation of Liability: My Travel Locker Storage takes considerable precautions to maintain a secure environment for all stored items. However, due to the inherent vulnerabilities associated with digital data — such as hardware failure, corruption, or technological obsolescence — we must clarify that we cannot accept liability for the loss or corruption of digital files stored within our facilities.

Customer Responsibility: By storing digital files in our storage bins, customers acknowledge and accept the inherent risks associated with digital data storage. It is the customer's responsibility to ensure that all necessary preventive measures, including the creation and maintenance of multiple backups, have been taken prior to storage.

Proactive Data Protection: Adherence to the above guidelines is crucial for the protection of your digital files. By maintaining up-to-date backups and utilizing multiple storage methods, you can safeguard your data against loss, corruption, and other unforeseen events.

Policy Compliance: Your cooperation with this policy is essential for the effective protection of your digital assets. By entrusting your digital files to My Travel Locker, you agree to abide by these recommendations and acknowledge the limitations of our responsibility for your data.

Article 13: Right to Enter, Inspect, and Move Your Locker

Initial Procedure and Documentation: Upon receipt of your Tote/Bin, My Travel Locker shall document its condition by capturing up to five photographs. These images, which will be stored securely on our Detrack App Server, typically include two to three photos of the Tote/Bin's exterior and one of its label. These photographs will be emailed to you for your records. This process is part of our commitment to transparency and ensures that both parties have an accurate record of the item's condition at the time of storage.

Conditions for Inspection: While it is not our standard practice to access the interior of your Tote/Bins once sealed, we reserve the right under certain conditions to open and inspect any Tote/Bin. These conditions may include, but are not limited to:

  • Emergencies requiring immediate action.

  • Suspected criminal activities or storage of prohibited items.

  • Detection of odd odors, mold, or must indicating potential damage or health hazards.

  • Any instances of default under the terms of this Agreement.

Legal Compliance and Law Enforcement Cooperation: In the event that My Travel Locker receives a valid search warrant or subpoena from a government agency, we are authorized to:

  • Break the seal of the relevant Tote/Bin(s) without incurring any liability to you.

  • Permit the search of the Tote/Bin(s) and, if necessary, allow the seizure of contents.

  • Provide requested documents or information about your locker to law enforcement or government agencies without incurring liability to you for such disclosure.

Locker Relocation: After the initial pickup, your locker will be stored at a My Travel Locker facility. You acknowledge and agree that My Travel Locker retains the right to relocate your locker to another facility within the State of California at our sole discretion. Reasons for such relocation may include, but are not limited to, facility maintenance, optimization of storage space, or compliance with legal regulations. It is important to note that any such relocation will not affect your financial obligations to My Travel Locker during the term of your storage agreement.

Customer Acknowledgment: By using My Travel Locker services, you acknowledge and agree to the terms outlined in this Right to Enter, Inspect, and Move Your Locker policy. Your cooperation ensures the safety, security, and legal compliance of the storage services provided by My Travel Locker.

Article 14: Temperature & Climate Control Policy

Commitment to Storage Environment: My Travel Locker is dedicated to providing an optimal storage environment for your Tote/Bins. We maintain our facility within a temperature range of 65°F to 80°F to ensure a climate-controlled setting that supports the preservation of your belongings.

Scope of Climate Control: While we endeavor to maintain a stable temperature, please be aware that our climate control measures primarily address temperature regulation. Specific factors such as airflow, humidity, and localized heat variations are not individually controlled for each Tote/Bin. Our efforts are aimed at creating a generally suitable environment for stored items within the broader parameters of temperature control.

Limitations and Liability: Despite our commitment to maintaining a regulated environment, it is important to understand that our facilities are not equipped to provide personalized climate conditions for each stored item. Therefore, we cannot extend a guarantee against the natural occurrence of mold, mildew, or similar microorganisms.

We undertake commercially reasonable efforts to prevent conditions that could lead to the growth of such organisms. However, the complete prevention of mold, mildew, or other microorganisms is beyond the scope of our controlled environment due to varying factors such as item susceptibility and pre-existing conditions.

Customer Acknowledgment: By choosing to store your belongings with My Travel Locker, you acknowledge the inherent risks associated with storage, including the potential for mold and microorganism growth. You agree that My Travel Locker shall not be held liable for the natural development of such organisms on or within your property. This acknowledgment is an integral part of our agreement, underscoring the shared understanding of the limits of climate-controlled storage.

Recommendations and Assistance: We recommend that you take all possible precautions to protect your belongings prior to storage, especially items sensitive to temperature and humidity. If you have specific concerns or need guidance on preparing your items for storage, our team is available to assist. We can provide recommendations for packing materials and strategies to further protect your items from environmental factors.

Policy Review and Compliance: We encourage all customers to review and understand the terms of this Temperature & Climate Control Policy. Compliance with and acknowledgment of this policy are essential for a mutually beneficial storage arrangement. Should you have any questions or require additional information, our customer service team is ready to help.

Article 15: Property Disputes Policy - Effective January 1, 2024

Procedure in Event of a Property Dispute:

  1. Withholding of Property: In the event of a dispute, My Travel Locker will not release any items from your Locker to a third party claiming ownership without a valid court order or a binding arbitration ruling.

  2. Neutrality: My Travel Locker will maintain neutrality in all property disputes and will not take sides. Our role is to ensure the safekeeping of your items while legal ownership is determined.

  3. Claim Process: If an individual claims ownership of items within your Locker, we will require them to complete a form under penalty of perjury, detailing their claim. This form is designed to protect all parties involved and to ensure that claims are made responsibly.

  4. Indemnification and Arbitration: The claimant will be required to indemnify both you and My Travel Locker against any resulting costs should their claim be proven invalid. They must also agree to offer you the option to resolve the dispute through arbitration, with the understanding that the losing party will be responsible for the winner's attorney fees and costs.

  5. Notification and Response: Upon receiving a completed claim form, My Travel Locker will provide you with a summary of the claim and a form for you to contest the claim, should you choose to do so. You will have a 30-day grace period to dispute the ownership claim.

  6. Resolution: If you dispute the claim, My Travel Locker will take no further action, leaving the resolution to you and the claimant through the agreed-upon arbitration process.

Financial Responsibility: In signing this Agreement, you acknowledge the possibility of being billed for the costs associated with resolving disputed property claims, including internal staff costs necessary for returning disputed items.

Commitment to Fairness: My Travel Locker is committed to ensuring fairness and due process in resolving property disputes. We aim to protect your interests while facilitating a clear and lawful resolution process.

Disclaimer and Limitation of Liability: Services provided by My Travel Locker are offered on an "as is" basis without warranties of any kind, except as prohibited by law. We limit our liability according to the terms outlined in this policy, with the maximum liability capped at $50.00 or the aggregate limit specified in your chosen protection plan, whichever is greater.
