This Arbitration Agreement applies to all disputes arising out of or related to your use of services provided by My Travel Locker, LLC, except for actions seeking equitable or injunctive relief. In the interest of resolving disputes efficiently and privately, you and My Travel Locker, LLC agree to final and binding arbitration as the sole and exclusive remedy for such disputes, pursuant to the rules and procedures of the JAMS arbitration and mediation service.

Arbitrator Selection Process:

Both parties shall mutually agree upon an arbitrator. If there is no agreement on an arbitrator within thirty (30) days from the notice of intent to arbitrate, each party will select an arbitrator affiliated with JAMS. These two arbitrators will then jointly appoint a third arbitrator who will resolve the dispute. The decision rendered by the arbitration panel will be conclusive, final, and binding upon both parties, and it will have the same force and effect as a judgment in a court of law.

Arbitration Procedures:

The arbitration will be conducted in Orange, California, and proceedings will be conducted in English. If the dispute involves a claim of less than $10,000, either party may choose to proceed with non-appearance-based arbitration via telephone, online communication, or based on written submissions; otherwise, standard JAMS arbitration procedures will apply.

Legal and Court Enforcement:

Any judgment on the award made by the arbitrator may be entered and enforced in any court of competent jurisdiction within the State of California.

Acknowledgment of Arbitration:

This arbitration clause constitutes a significant part of our agreement. By entering into this Agreement, you acknowledge and agree that you are electing to resolve all disputes through arbitration and waiving your right to litigate disputes in a court of law. Should you disagree with this arbitration agreement, you should refrain from executing this Agreement.

Article 17: Entire Agreement

Scope and Finality of Agreement:

This Agreement, along with any written amendments, addenda executed concurrently, and any notices provided under this Agreement by My Travel Locker, LLC, encapsulates the full and entire understanding and agreement between the parties with respect to the subject matter herein. This Agreement effectively supersedes and nullifies all prior agreements, representations, and understandings, whether oral or written, pertaining to the subject matter of this Agreement.

Exclusivity of Terms:

The terms and conditions set forth in this document, including the Storage Rules, Privacy Principles, Standard Pricing, and Service Zones as detailed herein, represent the sole and complete agreement between you and My Travel Locker, LLC. No representations, warranties, or agreements exist or shall be binding between the parties unless explicitly stated within this document. Furthermore, no representative of My Travel Locker, LLC or its agents is authorized to make any representations, warranties, or agreements beyond those expressly outlined in this Agreement.

Modifications and Amendments:

Any modifications, changes, or amendments to this Agreement must be made in writing and require the mutual consent and signature of both parties, except as specifically provided otherwise within this Agreement.
